By accessing or using the WeddingDecor.com Design Studio at studio.weddingdecor.com (the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, do not use the Service.

These Terms constitute a legally binding agreement between you and WeddingDecor.com, a business based in Ontario, Canada.

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement and that all information you provide is accurate and complete.

The Service is an AI-powered event design studio that allows users to upload photos of event venues and inspiration images, select color palettes, and generate AI-rendered visualizations of how the venue may look when decorated.

AI-generated visualizations are artistic renderings only. They are not architectural drawings, vendor quotes, or guaranteed representations of any final event setup. Results may vary based on photo quality and inputs provided.

You must create an account to access most features. You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account
• Notifying us immediately at privacy@weddingdecor.com of any unauthorized use

We reserve the right to suspend or terminate accounts that violate these Terms.

Studio Pass

The Studio Pass is a one-time purchase that grants access to the Service for 90 days from the date of purchase. It is not a recurring subscription.

Credit Packs

Credits are consumed when generating AI design visualizations. Credits are non-transferable and expire when your Studio Pass expires.

Free Generation

Each new account is entitled to one free AI design generation. This free generation is non-transferable and limited to one per person.

Pricing

All prices are displayed in USD. WeddingDecor.com reserves the right to change pricing at any time. Price changes will not affect purchases already made.

Refunds

Due to the digital and immediately consumable nature of the Service, all purchases are final and non-refundable, except where required by applicable law. If you experience a technical issue that prevents you from using credits you purchased, contact us at privacy@weddingdecor.com and we will work to resolve it in good faith.

Payment Processing

Payments are processed by Stripe. By making a purchase, you agree to Stripe's Terms of Service. We do not store your full payment card details.

Ownership

You retain ownership of all photos and images you upload to the Service ("Your Content"). By uploading content, you grant WeddingDecor.com a limited, non-exclusive license to use, store, process, and transmit Your Content solely for the purpose of providing the Service to you.

Your Responsibility

You represent and warrant that:

• You own or have the necessary rights to all content you upload
• Your content does not infringe any third-party intellectual property rights
• Your content does not depict any person without their consent
• Your content does not violate any applicable law

You must not upload content that is unlawful, harmful, obscene, defamatory, or otherwise objectionable.

AI-Generated Visualizations

The AI-generated design images produced by the Service are provided to you for your personal, non-commercial event planning use. You may share them with your vendors, venue, or wedding party. Commercial resale or redistribution of generated images is not permitted without our written consent.

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to reverse-engineer, scrape, or extract data from the Service
• Upload malicious code, viruses, or harmful files
• Impersonate another person or misrepresent your affiliation
• Use automated tools or bots to access the Service without our written permission
• Circumvent or attempt to circumvent any security features or usage limits
• Use the Service in a manner that could damage, disable, or impair our systems

WeddingDecor.com and its licensors own all rights, title, and interest in the Service, including but not limited to software, design, trademarks, and content created by us. Nothing in these Terms transfers any intellectual property rights to you except the limited license to use the Service as described herein.

The Service integrates with third-party providers including Clerk (authentication), Stripe (payments), OpenAI (AI image generation), and Google Cloud (storage). Your use of these integrations is subject to their respective terms of service. We are not responsible for the acts or omissions of these third parties.

When you generate a visualization, your uploaded images are transmitted to OpenAI's API to produce the result. By using the Service, you consent to this transmission.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted or error-free
• AI-generated visualizations will be accurate, realistic, or meet your expectations
• The Service will be available at any particular time or location

AI-generated images are artistic interpretations only and should not be relied upon as exact representations of any venue or decor setup.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WEDDINGDECOR.COM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

Our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In those cases, our liability will be limited to the maximum extent permitted by law.

You agree to defend, indemnify, and hold harmless WeddingDecor.com and its officers, directors, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) Your Content; (c) your violation of these Terms; or (d) your violation of any third-party rights.

We may suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms or for any other reason at our sole discretion.

You may terminate your account at any time by contacting us at privacy@weddingdecor.com. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will do so, including Sections 6, 8, 10, 11, 12, and 14.

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any dispute arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation by contacting us at privacy@weddingdecor.com. If unresolved, disputes shall be submitted to binding arbitration or the courts of Ontario, Canada, as applicable.

If you are an EU consumer, you may also have rights to bring proceedings in your country of residence under applicable EU consumer protection law.

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms with a new effective date. Your continued use of the Service after changes constitutes acceptance. If you do not agree with updated Terms, you must stop using the Service.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and WeddingDecor.com regarding the Service and supersede any prior agreements.
